These Terms and Conditions govern the use of the Kael Studio website and the provision of interior design services by Kael Studio to clients. By using this website or engaging our services, you agree to be bound by these terms. Please read them carefully.

1. Acceptance of Terms

By accessing this website, submitting an enquiry, or entering into a design services agreement with Kael Studio, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please do not use our website or services.

These terms apply to all visitors and clients, including those who engage us through phone, email, or in-person consultation.

2. Services

Kael Studio provides the following interior design services, subject to individual service agreements:

• Space Analysis & Concept Brief — a single-session service including an on-site visit, spatial observations, and a mood board, delivered within 10 working days (MYR 480)
• Detailed Design & Rendering — comprehensive design development including layout, materials, 3D visualisations, up to three revision rounds, and a final design book, over a 6–9 week timeline (MYR 3,500)
• Renovation Oversight & Styling — on-site management during the renovation phase, including contractor coordination, quality reviews, weekly updates, and a final styling session, duration aligned with renovation timeline (MYR 2,000)

The specific scope, deliverables, and timeline for each engagement are confirmed in a written project proposal issued before work commences.

3. Engagement Process

All engagements begin with an initial enquiry. We will respond within one business day. Where a project is agreed, Kael Studio will issue a written project proposal detailing scope, fee, timeline, and deliverables. Work commences only after written acceptance of the proposal and receipt of the deposit (where applicable).

Changes to agreed scope must be requested in writing and will be confirmed in a revised proposal before implementation. Scope changes that extend the timeline or deliverables may incur additional fees.

4. Fees and Payment

Fees are as stated in the project proposal. All amounts are in Malaysian Ringgit (MYR) and are inclusive of service tax where applicable.

Payment Schedule

• Space Analysis & Concept Brief: Full payment due on booking confirmation
• Detailed Design & Rendering: 50% deposit on project commencement; balance on delivery of final design book
• Renovation Oversight & Styling: 50% deposit on commencement; balance on project completion

Invoices are payable within 7 business days of issue. Late payments may be subject to a 1.5% monthly charge on the outstanding balance. Kael Studio reserves the right to suspend work where payment is overdue.

Furniture, materials, and contractor costs are separate from design fees and are the responsibility of the client unless explicitly included in the project proposal.

5. Revisions

The Detailed Design & Rendering service includes up to three revision rounds. A revision round constitutes a consolidated set of comments or changes submitted in one communication. Additional revisions beyond the included rounds may be charged at an agreed hourly or flat rate.

Revisions are only available within the project timeline. Requests submitted after project completion are considered new engagements.

6. Intellectual Property

All design concepts, drawings, visualisations, mood boards, and written documents produced by Kael Studio remain the intellectual property of Kael Studio until full payment has been received. Upon receipt of final payment, the client is granted a non-exclusive licence to use the delivered materials for the specific project described in the proposal.

Kael Studio retains the right to use project images and documentation for portfolio and promotional purposes, subject to the client privacy and photography terms described in Section 7 below.

7. Confidentiality and Photography

Kael Studio treats all client project information — including property addresses, personal details, spatial photographs, and design preferences — as confidential. This information will not be shared with third parties except as necessary to deliver the agreed services (e.g., with contractors or suppliers engaged for your project).

Kael Studio will not photograph, publish, or share images of a completed project without the client's prior written consent. Clients who give consent for portfolio use will be informed of how and where images will be used before publication.

8. Cancellation and Withdrawal

Cancellation by the client

• Cancellation before work commences: deposit is refundable less any direct costs incurred (e.g., site visit travel)
• Cancellation after work has commenced: fees are payable for work completed up to the point of cancellation, calculated on a pro-rata basis
• Cancellation of Renovation Oversight after construction has begun: fees for completed site visits and coordination work are non-refundable

Kael Studio reserves the right to withdraw from a project where continued engagement becomes impractical or untenable — for example, in the event of non-payment, repeated scope expansion without agreement, or conduct that affects our ability to work effectively. In such cases, fees will be charged for work completed and the deposit will be refunded or retained proportionally.

9. Limitation of Liability

Kael Studio's liability to the client for any loss or damage arising from the provision of design services is limited to the total fees paid by the client for the affected service. Kael Studio is not liable for:

• Defects in workmanship or materials supplied by third-party contractors or suppliers
• Delays caused by contractor performance, material availability, or circumstances outside our control
• Changes in the client's preferences or requirements after design approval
• Indirect or consequential losses of any kind

Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence.

10. Third-Party Contractors and Suppliers

Where Kael Studio recommends or coordinates third-party contractors or suppliers, these parties operate under their own terms and are independently responsible for their work. Kael Studio does not warrant the performance of third parties, though we do exercise reasonable care in selecting parties we work with.

Any contractual arrangements between the client and contractors or suppliers are separate from and independent of the client's agreement with Kael Studio.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or from a design services engagement shall first be referred to good-faith negotiation between the parties. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

12. Website Use

The content on this website — including text, images, and design elements — is the property of Kael Studio and may not be reproduced, distributed, or used without prior written permission.

We do not warrant that the website will be continuously available or free from errors. We reserve the right to modify or withdraw any part of the website without notice.

Links to third-party websites are provided for convenience only. We are not responsible for the content, accuracy, or practices of linked sites.

13. Amendments to These Terms

Kael Studio may update these Terms and Conditions from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the website or our services after any update constitutes acceptance of the revised terms.

Where a project proposal has already been accepted, the terms in place at the time of acceptance apply for the duration of that engagement unless both parties agree otherwise in writing.
